Radiotherapy Clinics of Georgia, LLC Settles False Claims Act Case for $3.8 Million

Radiotherapy Clinics of Georgia, LLC, located in Decatur, Georgia, and its affiliates RCOG Cancer Centers LLC, Physician Oncology Services Management Company LLC, and Physician Oncology Services L.P. (collectively “RCOG”) have agreed to settle a consolidated qui tam action for $3.8 million.

RCOG was named in two separate complaints filed under the qui tam provisions of the False Claims Act by whistleblowers R. Jeffrey Wertz and Rebecca S. Tarlton, former employees of RCOG. The whistleblowers claims were later consolidated into one action.

The whistleblowers alleged in the qui tam complaints that RCOG overbilled Medicare for oncology services provided to Medicare recipients and billed for services that were not medically necessary. Specifically, the whistleblowers alleged that RCOG violated the False Claims Act by billing Medicare in excess of Medicare guidelines for x-ray images of the treatment area and for the production of special consultative reports. In addition, the complaints alleged that RCOG ordered and billed Medicare for pre-plans that were not medically necessary and/or were never reviewed by the doctor.

The relators will share $646,000 of the settlement as their reward under the qui tam provisions of the False Claims Act.
